Sixteen Days Out: Early Voting Is Underway, Deadlines Are State-by-State, and Compliance Still Counts
With Election Day on Tuesday, November 3, 2026, now 16 days away, millions of Americans have already voted. The Associated Press reported that data gathered as of Thursday, October 15 showed more than 6 million early ballots cast for the midterm elections across 39 states, counting both returned mail absentee ballots and in-person early votes. California led with more than 757,000, followed by Florida, Virginia, Michigan and Pennsylvania AP via WRAL.
That early surge sits on top of a patchwork of rules. The Center for Election Innovation & Research reports that 47 states and Washington, DC offer early in-person voting to all voters, most of them beginning in mid-October CEIR. The calendars differ even between neighbors on the list: North Carolina runs in-person early voting from October 15–31 with an October 20 absentee-ballot request deadline NCSBE, while Texas holds early voting by personal appearance from October 19–30 and sets an October 23 deadline to apply for a ballot by mail Texas Secretary of State.
Turnout efforts also moved into the streets. The AP reported that rallies organized by the No Kings network were held on Saturday, October 17 in cities and communities across the U.S., with the aim of getting people out to vote early PBS NewsHour.
The legal and regulatory backdrop is shifting at the same time. On October 9, a federal judge struck down the Justice Department's policy of reviewing state voter rolls against federal immigration databases, CBS News reported CBS News. Campaign finance deadlines continue regardless: the Federal Election Commission lists monthly reports due October 20 and Pre-General reports due October 22 FEC, even as CBS News reported the agency lacks a four-member quorum, with only two of six commissioner seats filled CBS News. And the battlefield remains wide. NPR reported that Cook Political Report listed 43 House districts as competitive, including 22 toss-ups NPR.
Why it matters
Early returns at this scale change the shape of the final stretch. Once a voter's ballot is in, further contact is wasted effort, so the remaining work increasingly centers on supporters who have not yet voted. Because early-voting windows, request deadlines and registration options vary by state and county, the reliable guide is each official state and county schedule, not a single national calendar; official registration checks and documented list sources are the sound basis for voter assistance and data work.
The FEC's missing quorum does not move the filing calendar, so compliance dates still deserve confirmation with the responsible treasurer or compliance counsel. Verifying each voter's current district assignment before final turf is cut remains a basic safeguard.
